Breaking Australian immigration news brought to you by Migration Alliance and associated bloggers.
Migration Alliance queried the status of Priority Group 5 applications last week. The DIBP have responded as follows:
Dear Ms Allan, XXXXXXX [name removed for privacy reasons] passed your e-mail to the Skilled Migration Policy branch as the issues raised by your members are handled in this branch.
As you would appreciate, Australia runs a demand driven skilled migration program to meet the current and emerging skill needs of the Australian labour market and to strengthen the whole economy. Skilled migration policies are tailored to meet this objective and have always changed to reflect the prevailing economic conditions of the time.
I note the frustration expressed by some migration agents at the length of time taken to process skilled migration visa applications. The Australian Government understands that migration is a major life decision and can be emotionally and financially stressful for applicants.
Australia is fortunate in that the number of people seeking skilled migration far exceeds the number of places available in the programme. The Department of Immigration and Border Protection can only grant the number of visas allocated by the Government in the annual migration programme and so must prioritise the order in which skilled migration applications are processed through priority processing arrangements. Priority processing arrangements ensure that the economy gets the skills it needs now, rather than those of visa applicants who applied first.
The Government is aware that priority processing impacts on many applicants who will have a longer wait for their visas to be processed. However, the Government must also take into account the effect of the difficult labour market conditions which migrants, Australian permanent residents and citizens currently face. Priority Group 5 applications are allocated when all available applications in higher priority groups are allocated, or in line with planning level requirements for each of the visa categories.
The Department is unable to give specific timeframes for when individual applications will be finalised, as this will depend on when the person applied and how many applications are received in higher priority groups. It is not possible to process applications outside of the priority processing arrangements. Applicants will only be contacted once their application is allocated to a case officer.
Information on priority processing and allocation dates is available on the Department of Immigration and Border Protection website at:www.immi.gov.au/skilled/general-skilled-migration/estimated-allocation-times.htm.
Regards.

Hi Sidra,
I know how you feel, my partner and I are stuck with an 886 like you and I also had all the points to apply for an 885 this is thanks to the unprofessional advice of an immigration agent, have you though about complaining about your immigration agent and ask for a refund? in 2010 he should have been well aware of the impact of the new Priority system and should have not advised to apply for an 886. That's what I am trying to do as well....we paid 15000 for the application and 10000 were only his fees.
Pls come and join our facebook grouphttps://www.facebook.com/groups/764806566939293/?ref=bookmarks
if you are not on facebook pls send me your email address on iaiasydney@hotmail.com and will include you on our mailing list we are trying to take some actions.
Cheers
Ilaria
I was screwed up by Immigration Agent as well. I finished my 1st degree MBA in 2008 and lodged PR but got rejected because I completed my course less than 24months, I did it in Trimesters.. My agent didn't know that. I applied for another relevant course and make up the 24months fulltime studied requirement, then lodged a new application my self, I trust agent no more. They only care about your money. My agent: Australian Visa Professionals in Perth, name and shame!!

Hello Liana,
Thanks for your posted this blog and thanks to all of them who supported this blog today this blog is hit by more than 8000 time.
Dear Liana could you please find any way there We can address our story and situtation to media beacuse i think only media support we can get all our answer from DIBP. Like ( when CAT5 application will be process). thanks
I found this website is the most updated one. I feel the pain too as we have been waiting for 5 years now!!!! I know I am not the only one here who has been waited for this long and YES, raise up our voice and let them know we are here! And we are contributing to Australia and we didn't come here by boat!
DIBP's reply as produced in this blog to Liana 'Australia's skilled migration programme exists to ensure that Australia receives the skills and attributes required in the medium- to long term.As such ,priority is given to those applicants who can best meet these requirements'
I have the following questions
1-Why did DIBP not refuse the applications made in May & June? the new skilled list was out on the 17th of May,2010.I applied after the 23rd of June.2010 ,I had all the points needed & a positive skills assessment AND we were encouraged to apply BEFORE THE DEADLINE BECAUSE THE RULES WOULD CHANGE---We should have been warned about the long wait. This means DIBP was aware of what they were going to do with these applicants, inshort they needed our money.
2-The point I am repeatedly making- An Engineering student gets his PR within 6 months of completing his course and he works as a salesman or a recruitment consultant or some other management position because no company will employ him as he is inexperienced. HOW IS HE MEETING THE REQUIREMENTS OF AUSTRALIA'S SKILLED MIGRATION WHEN HE IS NOT WORKING AS AN ENGINEER? This goes to prove that the management jobs are in demand because even the engineer is working in that field.
Imagine the mess within when we get answers like this from DIBP. Atleast this proves that we have the brains and we deserve to stay after spending so much on fees and wasting our youth.
The refugees have lawyers to defend them,we have no one to defend our case eventhough we are right.
My suggestion would be for DIBP to wait till these students prove that they are working as Engineers and contributing to Australia's requirement---I'm sure very few visas will be issued.
I think it's high time DIBP started growing a conscience, there are lives and families on hold--We are only asking for what you have agreed to give us and what we have paid for.
What is more frustrating is that it's like an honest man losing his case in a court of law because he had no lawyer but the wrong one wins the case because he had a good lawyer.Let this be a lesson for all in the future as well.
I think you should name it the HAUNTING VISA
Its been five years today, i am still waiting for my PR. Scored 8 bands , got my diploma, bachelors and now masters all from Monash University which is suppose to be a good university. My case is as simple as u can get, my brother who himself is a permanent resident of Australia since 2002 sponsored me under 886.I am so devastated that only option left is #NameandShame i am planning to make this issue a serious one now in INDIA.Indian Governments intervention is needed now as we are still Indian citizens holding Indian passport. I have already written to Indian channel Times Now and they have agreed to raise a debate at Prim time on Times Now channel. They are trying to invite the Australian High Comissioner to India and few other migration agents from India & overseas to talk about this pathetic state of affairs. Its high time Australia understands that We are more important that refugees on boat & dole budgers.
Well said Nish!!! When we applied, we weren't told we'd have to wait at the bottom of every new year's applications. Why do we have to be pushed back when we applied as per the priority processing of the respective years we applied in - 2007/2008/2009/2010...??? why do we have to go right back to where we started every time someone new applies, every year? This is bull****! When will the married ones here on this boat ever get to live a peaceful life like that? when will the single ones find the opportunity to marry someone? And when can the women start planning babies? All those women on this boat, I hope they've kept their batteries out, otherwise it's gonna be too late to have children later. Biological clock is ticking. But DIBP is in no hurry!
I don't understand how did hair dressing and cookery go into priority processing for skilled migration? Every job is respectful but Hair dressing and Cookery really? Skill it is but critical skill to Australia? And DIBP put us all off while granting visa to every that category. Does DIBP have stats on how many of those don't take dole now? how many of those are working in their fields now? It's difficult even finding how many people are stuck like us here. Talk about 'people our business'.
Atlast someone had the sense to realise that the Education Industry is being misused.I have been stating from a long time that students just produce a work experience certificate of 1 month which is mandatory for the completion of some courses like engineering, food technology etc.
The University doesn't verify the authencity of that certificate and the students get through the course and apply for PR.
The University get their fees ,the agents get their fees, the government improves their economy and this is precisely what is happening. If DIBP reviews the visas of all these students in professional courses for just the past 3 yrs ,it will have to cancel all those visas coz 95% of the students have got thro in this manner.
This is what upsets me,honest people are waiting in line for years and to add insult to injury when such things are highlighted there is no one to stand up for us?If DIBP can verify Police clearance certificates and stuff like that,WHY NOT VERIFY EXPERIENCE CERTIFICATES PRODUCED BY STUDENTS DOING ENGINEERING AND OTHER COURSES????
WE ARE WAITING BECAUSE DIBP IS NOT PUTTING AN END TO THE CHEATING GOING ON.
THERE WILL BE PLENTY OF VISAS AVAILABLE IF SOMEONE CHECKS THE AUTHENCITY OF THESE CERTIFICATES.Students just travel back to their homeland and go back to Australia in a month with a certificate,WOW and you believe that????
I know how DIBP works-Now the condition for the work experience will be removed so that they get more students into professional courses, inshort professional courses with longer duration bring in more money.
It's more easy for a mason to become a cleaner and then an Engineer and get a job as an engineer than a student to directly work as an engineer unless he lies and produces a certificate. If he directly studies for engineering he might have to work as a salesman or a cleaner but according to DIBP he is solving the skills shortage--it's not his skills that's solving the problem it's his money. We are not stupid and we can see through all these things.
A few genius heads got together to create this terrible mess and there's no one with a clear conscience to clear it.Atleast clear the applicants who have been waiting over 4 yrs,you have messed up our lives and we are actually the honest ones, that's the sad part!!!!!
Hello Fellows,
Quite interesting life stories here. I'm in the same boat for nearly 6 years now. Same generic emails from the department just different people who reply.
Can, by any chance, we all together take an action rather than sharing our frustrating experience here?
any ideas?
Also, any lucky applicant in last 5 years in this category who got PR?
Rao

Hello guys,
good news for one of my brother in law. He got his file allocated yesterday. He was waiting for last six years. Hopefully it will be quick now that he will get his PR. my another brother in law is waiting from last 5 years. I have heard that immigration department is going to clear many cases by end of July.
hi all,
Going through the comments, and can feel the frustration as i am going through the same problem. Applied my 886 in June 2010 and waiting since. I have 2 kids 9 &4 already paying for 9 year old's education wouldn't be able to pay for 4 year old when he starts school next year. people who studied with me got their PR ages ago as they applied on 885, and I am suffering just because I went with the advice from migration agent although I had all the points required for 885.
