Priority Group 5 applications for 886 and 176 visas: DIBP update

Migration Alliance queried the status of Priority Group 5 applications last week.  The DIBP have responded as follows:

Dear Ms Allan, XXXXXXX [name removed for privacy reasons] passed your e-mail to the Skilled Migration Policy branch as the issues raised by your members are handled in this branch. 

As you would appreciate, Australia runs a demand driven skilled migration program to meet the current and emerging skill needs of the Australian labour market and to strengthen the whole economy.  Skilled migration policies are tailored to meet this objective and have always changed to reflect the prevailing economic conditions of the time. 

I note the frustration expressed by some migration agents at the length of time taken to process skilled migration visa applications.  The Australian Government understands that migration is a major life decision and can be emotionally and financially stressful for applicants. 

Australia is fortunate in that the number of people seeking skilled migration far exceeds the number of places available in the programme.  The Department of Immigration and Border Protection can only grant the number of visas allocated by the Government in the annual migration programme and so must prioritise the order in which skilled migration applications are processed through priority processing arrangements.  Priority processing arrangements ensure that the economy gets the skills it needs now, rather than those of visa applicants who applied first. 

The Government is aware that priority processing impacts on many applicants who will have a longer wait for their visas to be processed.  However, the Government must also take into account the effect of the difficult labour market conditions which migrants, Australian permanent residents and citizens currently face.  Priority Group 5 applications are allocated when all available applications in higher priority groups are allocated, or in line with planning level requirements for each of the visa categories. 

The Department is unable to give specific timeframes for when individual applications will be finalised, as this will depend on when the person applied and how many applications are received in higher priority groups.  It is not possible to process applications outside of the priority processing arrangements.  Applicants will only be contacted once their application is allocated to a case officer.

    We filed our application in 2008, now it more than 6 years . After that we got an email from the department that, they have received a valid visa application and it will get processed with in the next few months. Now it is more than 6 years , they are frequently changing their LAW according to their convenience. ( I don't know whether this can be called ''Law'', or a trick of a thief )
    No civilized country in the world do like this , but would re-fund the application money along with a decent compensation.
    This is nothing but cheating. Don't they have shame to take other countries money by cheating?
    They themselves are saying that there are thousands of applications pending in priority group 5 , so it is evident that they have grabbed billions of dollars by unlawful means from innocent citizens of other countries, who acted in good faith by believing their claim in their official website .
    If an individual commits these kind of act, we will call him a thief, and if there are group of individuals behind ,then we will call them dacoits or deceits.
    Hence we have a humble request to the ''authorities'' of this country to change the name of their country to match their action

    1-All the 886 visas in PRIORITY 5 chose a skill on the list made available by the Australian government at the time of applicationso it is unfair to call them unskilled.
    2-Many of the Engineers ,Doctors & other so called professionals who get their visas faster are working in the very same jobs termed as 'unskilled' untill they can find jobs related to their education which means the other jobs are in demand.
    3-Australian education is expensive as compared to US &UK but we still chose Australia because we have family here,especially if it's a single girl.
    4-My daughter was awarded the PHd scholarship for international students but declined because she had applied for the PR,thinking it would happen in a year,this was in 2010.We had taken an education loan to send her to Australia,we sold our house in the city and moved to the town to help her out.Since she is on a Bridging visa,even getting a mobile or a good job is expensive,they pay the tax on the salary but with no benefits.
    Normally a student with that kind of focus and intelligence would have been in a good position by now but with this policy my child struggles to meet her expenses.Many of her friends have changed their mind about studying in Australia after seeing her plight.
    6-SUGGESTIONS-I think if the government would agree to stamp visas to those who are ready to leave Australia for a period of 5 yrs,there would still be many who would accept that.
    7-If the government is seriously thinking of boosting the economy through the Education sector,it needs to do some soul searching.
    COMPLAINTS-Are the authorities verifying the work experience certificates produced by the students in engineering ,medicine ,food technology and other such areas where work experience is mandatory to complete the course?
    Is it fair and is it justified that those students who cheat get through while the 886 wait?
    COMPLIMENTS-You have very good universities and my daughter was very lucky to have excellent professors to guide her through out her studies but the immigration policy has made her a case of "OPERATION SUCCESSFUL BUT PATIENT DEAD"
    My heart goes out to all those people especially students whose future has gone to dogs
    Please don't turn intellectuals into refugees,u need to keep your part of the bargain too.

    Seems like government has involved into illegal business. They encourage people to apply ENS, RSMS which cost around $10000 to lodge (with secondary applicant). That is the reason this two visa categories are in front of priority group. For 886 visa application we paid $2500 to lodge. Government made millions from us. Now they are looking fresh faces for more money, completely ignoring 886, as they don't have anything to get from this group. This is an easy cheating from superior authority of a country whom people trust.

    I m in the pipe line... I applied in the end of Dec 2009. The department processed up to 11 Dec 2009, stopped processing 886 visas in May 2013 and finalized all 885 and 175 visas. The frustration is to the top level... We are being punished for paying tax, for having spent thousands of $$$$ to this government basically punished for doing the right thing!!!
    No one can help. When you mention GSM group 5 every door shuts in your face...It's soo unfair.

    A recourse on the internet says that there was about 3734 of GSM Group 5 applications were withdrawn over the last 3 years. Each has payed the department $2550 application fees. That sums up to $9521700... In other words, that's how much the government ripped off these people who ARRIVED LEGALLY to Australia, spent thousands of $$$ and continuing to work and pay tax... Not to mention the psychological damage they caused us!
    I would remind the Minister/Ministry that gives the direction to DIBP to allocate case officers that we are the ones that contribute more than other groups received their visas before us, relied on Centrelink (in most cases) and who are still costing tax payers $$$... I love this country and I was told this it has the fair go slogan that's why I decided to stay. I would like to ask; where is the fair go for these cases?!

    I think we all need to stand together and sort this matter out.because people like us have done the right thing and applied according to the immigration.sometimes we have to do something so that our voice can be heard.i dont know how it can be done but really immigration need to hear our voice and sort out those applications which are waiting from last 6 years.i am in same boat like everyone else.waiting from last 5 years.lets do something about it so that our voice can be heard.thank you

    I m on the same boat too. I v got not too much to add on to the above comments... It's clear rip off and unfair act by the government!
    We need a strong advocacy and more comments to be heard. There is only a few of us who commented on this blog. There is about 10,000 cases waiting allocation and in the pipeline! where are they? where are their migration agents??!! It's also at the best interest of the migration agents for these cases to befinalised... Some times I wanna yell out, Help someone please!!!!

    What I would be interested to find out is if there is any research being done into the management of the 886 visa holders? If so, who is conducting it and and there will be any positive outcomes for us as a result.

    I'd also like to know how to find out what legal rights we have to stand up against the inaction of the Department in relation to this.

    Lets all stand against this issue. Lets prepare a petition, get it signed by maximum people on 886 and send it to Minister for Migration , one copy to opposition and one to Prime Minister of Australia. These is now a serious issue, if we stay quiet i can guarantee they will not process any application till 2018. Please stand united and we cant get it done. If interested lets share our email addresses and then one of us will prepare the petition and will get every one to sign it.
