Priority Group 5 applications for 886 and 176 visas: DIBP update

Migration Alliance queried the status of Priority Group 5 applications last week.  The DIBP have responded as follows:

Dear Ms Allan, XXXXXXX [name removed for privacy reasons] passed your e-mail to the Skilled Migration Policy branch as the issues raised by your members are handled in this branch. 

As you would appreciate, Australia runs a demand driven skilled migration program to meet the current and emerging skill needs of the Australian labour market and to strengthen the whole economy.  Skilled migration policies are tailored to meet this objective and have always changed to reflect the prevailing economic conditions of the time. 

I note the frustration expressed by some migration agents at the length of time taken to process skilled migration visa applications.  The Australian Government understands that migration is a major life decision and can be emotionally and financially stressful for applicants. 

Australia is fortunate in that the number of people seeking skilled migration far exceeds the number of places available in the programme.  The Department of Immigration and Border Protection can only grant the number of visas allocated by the Government in the annual migration programme and so must prioritise the order in which skilled migration applications are processed through priority processing arrangements.  Priority processing arrangements ensure that the economy gets the skills it needs now, rather than those of visa applicants who applied first. 

The Government is aware that priority processing impacts on many applicants who will have a longer wait for their visas to be processed.  However, the Government must also take into account the effect of the difficult labour market conditions which migrants, Australian permanent residents and citizens currently face.  Priority Group 5 applications are allocated when all available applications in higher priority groups are allocated, or in line with planning level requirements for each of the visa categories. 

The Department is unable to give specific timeframes for when individual applications will be finalised, as this will depend on when the person applied and how many applications are received in higher priority groups.  It is not possible to process applications outside of the priority processing arrangements.  Applicants will only be contacted once their application is allocated to a case officer.

    Thanks Liana for listening to us.We are not upset that the government changed the policies,ofcourse every govt. has the right to do what they feel is right for their citizens,we respect that.What they also need to keep in mind is that we have passed IELTS,we have passed the assessment and applied for a job on the list before july 2010,so how can they just sweep us under the carpet.My daughter gave up the PHd scholarship thinking she would get the PR and then apply for it as a resident cause the scholarship was only for internatinal students and she had already applied for the PR.She would have taken up the scholarship if we knew the wait was fr 5 yrs.The job she had applied for is not currently in SOL,but there are thousands of vacancies everyday in that field so how can it be said that there is no demand?She had secured 91% in finance and could have gone to any part of the world but we chose Australia because we have family there.For parents who are involved and focussed about their children,having a relative around is a big help especially if we are sending them abroad for the first time.My conception about Australia was based on what I heard from family living there which was all good.What hurts me the most is that that very same relation has come as an obstruction. These category cannot get a good job,they are over qualified for some jobs,buying a mobile is expensive,people are hesitant to rent houses,the list goes on ---yet they have to pay taxes.Normally good talent is rewarded and family sponsorship is encouraged but it seems like a punishment now..Children who came for a better future have been wasted,so many lives and homes have been disrupted not just for the ones who are there but even for parents like me who have taken loan to give my child a good life in Australia.If all these people are still working it proves a fact that Australia can absorb them.
    The situation of these people are like an 886 Australian flight that is over Australia and not allowed to land cause they have relatives there.It's so sad,they cannot come back because of the money they have spent and they cannot stay there because there is no sense of direction.So what happens when the flight crashes?We get visas easily to go and collect them?Please somebody in immigration listen to our cry.If we waited this long it also shows that we love Australia

    Dear Liana,

    That would be great, I am looking forward to it. If your article can make Immi starts processing our applications again, you will be our hero. It will change our fate and give us hope again.

    Cat5 is an abandoned group. I have been here 10years. 3years in Uni and 7years fulltime employed. So far every requests, which I believe it reasonable, I made to the Department have been ignored.

    First request: I worked for government department, I needed be a PR to get permanent employment. Begging them to help me to save my job. Why do I have to be sponsored when I am employed. Well Noone cares.

    Second request: My elderly father is unwell, undergoing a few operations. His health is up and down. I requested them waive bridging Visa B application fee $140 as I applied for this visa 2-3times a year to see my parents/accompany them to hospital. It is not a holiday, if Immi has not changed the rule I would get my PR by now and dont need to go through this painful process. I got another No.

    Third request: If they can waive application fee if I lodge employer sponsorship or partner sponsorship, and waiting time as I have been waiting 5years for my 886. If I knew this, I wouldnt apply for family sponsorship application. At the time it was the best option for me, who knows it became the worst choice now. Again No. I have to pay new application and documents all over again if I lodge a new application. I feel like I am being punished for being independent.

    I find Immi is heartless, blood sucker, no compassion. If all 886 just sit back and do nothing, you will be waiting forever. If this important to you, you have to fight for your right. Some people have more to lose than us but they still didnt get any sympathy from Immi.

    It's a unbearable pain for Cat. 5 FS, who passed all requirements and doing job in Australia and overseas on their skilled filed, and settle their life in Australia who applied onshore. Now we are not granted because we sponsored by their family. All we waiting for undecided future because of the harsh policy. I could not figure that out what is difference between 175 & 176, 885 & 886 just because we sponsored by family? Is it not a good thing that we have family here :)

    Hi All
    I have been reading these comments lately now only and bit nice to see some efforts being made from some people at least. I am a family sponsor of 886 applicant and I am myself really disappointed, stressed, frustrated and much more and thereby I can imagine how much emotional dilemma you people might be passing through as well.
    This is definitely a BIG NEED of time and especially for Victorian people as elections are coming to put this demand ahead.
    We need to bring this issue up and create awareness in active manner.
    Secondly I am not very satisfied with the petition raised, as its pointing to the circumstances of one person, the petition needs to be raised globally. The petition needs to be presented in a professional way.

Dear friends this is free on cost petition nothing to pay just spent your one minute to sign this protest ion and write down what ever you want..... This is free free free free.............
    Why I am interested for this petition because if we see their past petition and people win because they are supported by group of people so we need thousands of supporter if we want to win... Thanks

    To 886 FamilySponsor, I agree with you. the Petition is not strong/interesting at all. I think it is going no where. We need someone with an excellent writing skill. We need support from 886ers, and mainly to make public agree with us..

    It is wasting time if just write a few sentences, copy and paste other people comments to make a case

    hi guys..... but we are many in category 5 waiting to for our application to get processed... why is this petition concern only one category of visas???? and it seems to me that its only concern one person!!!! I mean that "to get much signatures as we need" this should be open to all subclass in category 5.. including 176, 475, 487,496 and 886.
    we cant go only on one special case... to be hear from someone we must be a group not a single isolated case....
    I would like to request to the Minister about grant our family sponsered visa 886 . I arrivedin Australia on a student visain 2007 and applied for my permanent resident 2009 as family sponsored visa 886 this year it will be more then 5 years and i am married too i can't bring my family in Australia and i believe it is hard for anybody to survive without family.[b][/b]
