RMAs have also recently reported that processing times for Partner Visas are going well beyond DIBPs promised standards even with the department announcing that its currently taking up to 15 months to decide on the first stage of a partner visa application.
There have been suggestions that DIBP is “intentionally staggering visa grants across the program year, so as not to exhaust their entire allocation within the first few months. There are also suggestions that staff cutbacks and an increase in the number of low quality applications is increasing processing times.
"I have heard it said many applications prepared by the couple without professional guidance/assistance are manifestly inadequate and lead to refusals. This alone is often why a later professionally prepared appeal is successful… Perhaps the increase in refusals is due to an increase in couples preparing their own applications and I suggest this may well be driven by the increase in Partner Visa Fees,” says Robyn Oyeniyi, a prominent human rights campaigner and author of the book, Love versus Goliath on her website.
According to the statistics from the Administrative Appeals Tribunal (AAT) its current caseload consists of 10,626 cases related to migration review (excluding refugee reviews). While it is deciding about a 1000 cases a month, there is an average 1165 new cases being lodge each month.
Partner visa category cases currently on hand with AAT number some 4,270 or about 40% of the tribunal’s caseload. Most of the AAT review applications are generally being lodged in Sydney (40%) and Melbourne (36%).
Of the total cases decided, just under half are being affirmed and over a third being set aside. The others are either withdrawn or discontinued.
Cases are generally taking about a year to finalise.

Good day everyone
I am yet to apply for my partner visa 309 but planning soon. But having gone though the complaints above,am honestly scared by the undue delay suffered by each applicant. However, just what I noticed is that only one person I see applied through an Agent . obviously most people filled and submitted by themselves.
Pls, can some one clear my doubt if applying through an Agency will ultimately speed up the whole process.
PS...my wife is based in Aussie but am in Africa.

I am Australian and My partner from Nepal. we are a same-sex couple. we lodge 309 visas almost 1 year. we used a migration agent. But we don't know who is a case officer. My Heterosexual couple applies in October within 6 months they got a visa.
Is anyone suggest is any discrimination comes decision making in between a same-sex couple and heterosexual couple.
I have been waiting for 18 months now still waiting I don't know why they taking so much time!
I couldn't handle it being away from my fiancé so I went to visit him and send all the photos to the migration atill notking. We have set our wedding date this year fingers crossed he will be here with me.

For sammy it's not faster through an agent they just take money and don't do anything you need to it by yourself and keep calling the embassy. I have my lawyer I paid him $3000 what did he do!? Nothing only he logged my application as I was too scared to do it in case I make a mistake.
Hello everyone i applied my onshore defacto on july 9 2016 and just recieved my 820 may 17 2017 for 10 months waiting no agent.Im curious how long will take for 801 application and what are the further information documents? My partner status is approved and mine was finalised has anyone experience this situation. Thanks wish us all to get our application done.

Yes, this is true. In my case I got 801 because we could prove we lived together for over 3 years at the time of the application. But: you have to ask for it, otherwise they may overlook it and grant you the 820 instead. And note that this is for couples who have LIVED together for over 3 years at the time of APPLICATION, not the grant of the visa. So just being in a relationship is not sufficient.
I read ur previous comments tht u said u lodge ur 801 and it takes 15 months? I lodge my 801 last year on 19 dec so that's means no hope for me to get this year?? Unless I can proved tht I been living together for over 3 years.im low risk too. Here my List of documents tht I have lodge registered relationship ,joint bank account, lease bond receipt, gas bill ,boarding flight to overseas .of course other form of like 2 witness and form for me and my partner too

I think you misunderstood... if you can prove you are already living together for 3+ years when you apply for the 820, you can immediately go to the 801 without having to go through the two step system (820 application and then two years later 801 application). I applied for 820 (first stage) but went straight to 801 (after waiting 15 months for it to be assessed), because we lived together for 3+ years when we applied.
Ahhh I see thx for ur reply shar.i heard low risk country sometime will get process earlier than 6 months but I guess depends on how good the documents thy provide.i live in Sydney and the highest of all the city in Australia who apply the partner visa and I think my case been processed in Victoria.im thinking using the migration agent to push the immigration to process for me or Maybe I should just contact immigration department to process immediate. This 19 June will be 6 months now since I lodge 801.
