Processing times for partner visas are taking longer with many being refused

About 40% of the migration Tribunal’s caseload consist of dealing with Partner Visa refusals by the department of immigration, according to the latest figures from the AAT. Has the hike in the partner visa application charge resulted in applicants attempting this complex application on their own?

RMAs have also recently reported that processing times for Partner Visas are going well beyond DIBPs promised standards even with the department announcing that its currently taking up to 15 months to decide on the first stage of a partner visa application.

There have been suggestions that DIBP is “intentionally staggering visa grants across the program year, so as not to exhaust their entire allocation within the first few months. There are also suggestions that staff cutbacks and an increase in the number of low quality applications is increasing processing times.

"I have heard it said many applications prepared by the couple without professional guidance/assistance are manifestly inadequate and lead to refusals. This alone is often why a later professionally prepared appeal is successful… Perhaps the increase in refusals is due to an increase in couples preparing their own applications and I suggest this may well be driven by the increase in Partner Visa Fees,” says Robyn Oyeniyi, a prominent human rights campaigner and author of the book, Love versus Goliath on her website.

According to the statistics from the Administrative Appeals Tribunal (AAT) its current caseload consists of 10,626 cases related to migration review (excluding refugee reviews). While it is deciding about a 1000 cases a month, there is an average 1165 new cases being lodge each month.

Partner visa category cases currently on hand with AAT number some 4,270 or about 40% of the tribunal’s caseload. Most of the AAT review applications are generally being lodged in Sydney (40%) and Melbourne (36%).

Of the total cases decided, just under half are being affirmed and over a third being set aside. The others are either withdrawn or discontinued.

Cases are generally taking about a year to finalise.

    I have lodged my file last 24 February and medical done on 14 march for visitor visa and again hepatitis B and C are done on 18 January...it's going to be a year now in few days .can anybody tell me how long it's gonna take ?

    It's really difficult to stay away from your partner ... I really can't take it as I have spent 9 months together ....it's really really difficult .i use to cry every day missing him

    I know its so hard :-( but i need to know did you apply for your partner visa already ? from offshore as you said you have applied for visitor visa to come visit him is that right ? but as i know it wont be taking all this long for Visitor visa you should have an answer already speak to the Australian embassy in your country and follow up but for partner visa it will take 12-18 Months as what i know and from case to case is deterrent as you are from high risk country that why it will take long to be located to a case officer and for visitor visa it shouldn't take that long to give you an answer its should take maximum 1 month.

    Yea I applied partner visa 24 Feb and on 26 Feb applied for visitor ...I got my visitor visa after 1n a half month with medical done n visa is for 6 months n I extended my visa for next 3 months ...so the total stay in Australia is 9 months in that period of time CO is assigned in may requested to provide pcc .end of the may I have had provided all the documents after that I haven't heard anything until I came back to India.once ill came to India ,they want hepatitis test now I'm done with that as well . Don't know how long its gonna take now and yea applied offshore mean from India

    Ok now in 26/02/16 you have applied for your partner visa alright in your case you need to count 12-18 months to get your Temporary partner visa as I can see good luck for you.

    Hi, I lodge my fiancee visa subclass 300 in Philippines and granted about 6 months Feb 13, 2015 And i get married here in Australia last April 13, 2016 , and lodge my partner (Temporary ) Class Uk 820 last year Oct.23, 2015 and granted only five days Oct. 28, 2015 now im waiting for my PR subclass 801...it takes more than a yea rnow waiting.... anybody knows how long will be the processing time? DIBP never send any additional documents so far....Driving me nuts... waiting..Can anybody explain to me what is that second stage? thank you...cheers....

    Thanks Basheer for reply, when i lodge my application of onshore 820 yes i did provided all the documents like form 888 updated. So you mean is it separate application for 801?

    Yes it will be separate application you need to provide evidence from the date you got your 820.
    And you need to do Provide POlice clearance ones you lodge your 801 application.

    Hi Lyn
    First congrats, and for the processing time is 12-18 months for the second stage and you need to lodge all the evidence that you are in genuine relationship since your 820 granted till your eligible date and you need to do 888 form to be singed from people they know you they should have a Permanent Residence or Australian Citizen and in my experience as i know for your case you lodge onshore your 820 on 12/02/2015 thin your eligible date for 801 it should be on 12/02/2017 and from that date you need to lodge your 801 application with all your evidence again with 888 form singed by 2 people as i said before and form that date you need to wait from 12-18 months.

    Sorry you lodged ur partner visa on 23/10/2015 thin ur eligible date for your 801 23/10/2017 and on that's date you need to count 12-18 months to be granted your 801 thank you it's 2 years from your lodged ur 820 thank you

    My daughter is Australian and is currently living in Lebanon with her husband. They applied for her husbands spouse visa 9/10/2015. They had their interviews on 12/1/2016 and finally his medical on 9/9/2016. Currently awaiting Charachter/police check. How long does it take? The immi website quotes 15 months from day of application. Its been nearly 16 months. Beirut embassy will not give an upsate other than to say the application is progressing and average wait time us 18 months.

    Hi in your daughter husband case he need to wait between 12-18 months let your daughter to follow up with the embassy she can ask the case officer to give her some update about her husband case as she is the sponsor.

    in my experience as Lebanon with the immigration department list Lebanon its a high risk Country that's why takes all this time good luck to you Daughter family.
