Processing times for partner visas are taking longer with many being refused

About 40% of the migration Tribunal’s caseload consist of dealing with Partner Visa refusals by the department of immigration, according to the latest figures from the AAT. Has the hike in the partner visa application charge resulted in applicants attempting this complex application on their own?

RMAs have also recently reported that processing times for Partner Visas are going well beyond DIBPs promised standards even with the department announcing that its currently taking up to 15 months to decide on the first stage of a partner visa application.

There have been suggestions that DIBP is “intentionally staggering visa grants across the program year, so as not to exhaust their entire allocation within the first few months. There are also suggestions that staff cutbacks and an increase in the number of low quality applications is increasing processing times.

"I have heard it said many applications prepared by the couple without professional guidance/assistance are manifestly inadequate and lead to refusals. This alone is often why a later professionally prepared appeal is successful… Perhaps the increase in refusals is due to an increase in couples preparing their own applications and I suggest this may well be driven by the increase in Partner Visa Fees,” says Robyn Oyeniyi, a prominent human rights campaigner and author of the book, Love versus Goliath on her website.

According to the statistics from the Administrative Appeals Tribunal (AAT) its current caseload consists of 10,626 cases related to migration review (excluding refugee reviews). While it is deciding about a 1000 cases a month, there is an average 1165 new cases being lodge each month.

Partner visa category cases currently on hand with AAT number some 4,270 or about 40% of the tribunal’s caseload. Most of the AAT review applications are generally being lodged in Sydney (40%) and Melbourne (36%).

Of the total cases decided, just under half are being affirmed and over a third being set aside. The others are either withdrawn or discontinued.

Cases are generally taking about a year to finalise.

    hi
    im waiting for 18 months already and i dont know what they up to. I gave them all the proofs and my wife shes even my girlfriend since 17 years old, in total where more than 9 years in relationship. Im frustrated

    Hi everyone

    My husband and I lodged offshore - high risk india . Married this month for 2 years. Together for 3 years. Complex case. Still waiting patiently and our application was lodged through a Mara agent as well.

    12/5/16 Requested Police check & Medicals
    21/5/16 Medicals completed and uploaded
    4/4/17 Still waiting for an outcome - keep getting told 15 months for processing and our case is complex. I have had a look on the border.gov.au and some visas are taking up to 20 months for processing. We have emailed enquiry-india@border.gov.au and they keep responding saying they will contact us when the initial assessment has been reviewed.

    Waiting for any type of update so we can move on with our lives together. Never get any updates from them other than they will contact us if they need any information.

    Hi, I lodged my application on 11/1/2016... also still waiting (low risk country). Haven't heard anything since my application (no requests whatsoever). But I did apply onshore, so at least we can be together while we wait. I wish you all the best.

    Hi I applied my family (7 members) a tourist visa. I kodged their application through immiAccount and I received their grant notice after 23 hours. Every one got granted a muktiple entry for 1 year. It was lodge last March 27 and and grant notice was emailed yo us on the 28th. We're from the Philippines

    Hello, I am sponsoring same sex Partner De-Facto partner. I am Australian Citizenship. My partner from Nepal. we applied our application almost 11 months and 1 week.
    I don't know why two couple has to live separately like punishment in the different country. Why two genuine couple has to suffer from all anxiety and desperation with such long waiting period.
