RMAs have also recently reported that processing times for Partner Visas are going well beyond DIBPs promised standards even with the department announcing that its currently taking up to 15 months to decide on the first stage of a partner visa application.
There have been suggestions that DIBP is “intentionally staggering visa grants across the program year, so as not to exhaust their entire allocation within the first few months. There are also suggestions that staff cutbacks and an increase in the number of low quality applications is increasing processing times.
"I have heard it said many applications prepared by the couple without professional guidance/assistance are manifestly inadequate and lead to refusals. This alone is often why a later professionally prepared appeal is successful… Perhaps the increase in refusals is due to an increase in couples preparing their own applications and I suggest this may well be driven by the increase in Partner Visa Fees,” says Robyn Oyeniyi, a prominent human rights campaigner and author of the book, Love versus Goliath on her website.
According to the statistics from the Administrative Appeals Tribunal (AAT) its current caseload consists of 10,626 cases related to migration review (excluding refugee reviews). While it is deciding about a 1000 cases a month, there is an average 1165 new cases being lodge each month.
Partner visa category cases currently on hand with AAT number some 4,270 or about 40% of the tribunal’s caseload. Most of the AAT review applications are generally being lodged in Sydney (40%) and Melbourne (36%).
Of the total cases decided, just under half are being affirmed and over a third being set aside. The others are either withdrawn or discontinued.
Cases are generally taking about a year to finalise.

I lodged my first stage partner visa onshore in August 2014 and it was approved in November 2015 (15 months) and have just lodged my 2nd stage partner visa. I work at an Immigration firm and standard processing times we are seeing are at 15-18 months for both 1st and second stage onshore but offshore processing centers seem to have faster processing times (especially in the USA) for some reason
I lodge onshore partner visa in December 2013. I got 820 granted December 2014 no interview nothing . Then co sent me a letter to lodge 801. I lodged 801 in December 2015.after 6 months co sent me a letter to update my passport if I change my name or about to expire. Nothing heart from them till now. When i call, always waiting one hour , two hours.
Hi everyone,
I'm an Australian girl and my partner is Brazilian. We have an 11 month old daughter and a pa offshore partner visa that was lodged in January 2016. My partner came back on a tourist visa after visa was lodged and then left to hopefully apply for another tourist visa but it was refused. This is extremely difficult to be without my man and alone with our daughter. How long should I expect to wait for the visa? I keep seeing conflicting info. Offshore I thought was one year but now I have read 18 months. Does immigration seriously think it's acceptable to leave a mother alone with a baby for that long? I know many others are in this boat and I'm not saying my situation is any more deserving I'm just in utter dispair.
I submitted my application for 820 visa 22.12.2014 I was granted a temporary 820 visa 30.12.2015....I've been contacted by the immigration department to submit my papers relevant documents in respect to my 801 visa...I've undertaken all the relevant steps and my supporting evidence almost complete...so hopefully it's not going to be too long till we have the result....
How painful is being a way from your love
My fiancé and I lodged the application in
November 13 2015 still waiting till now.
It's been 11 months we have booked for
Our wedding and everything and now we
Have to reschedule the wedding till next
Year. They don't even say the right time I'm
Just wondering would it take more than 15
Months? I'm from Australia and my fiancé
Lives in Los Angeles. Any advice for me
Please?
Thank you
I lodge my application for 820 (onshore) on the 15/03/2015 and only got my 820 granted on the 28/11/16 - 20 months later!! I applied in NSW and my case was assessed in VIC. They only requested to do the medical exam again and a new police check.
Good luck to everyone!
It's been taking ages to hear from immigration. I suppose the second stage is going to happen in 15 months.
Contacted Australian embassy in NZ handling my 309 offshore partner visa which is now going on month 14 and I am back in Canada waiting. They transferred my file to the Australian embassy here and they have asked for the signed copies of the 1022 and 929 which were already signed scanned and uploaded but did them again. Last thing now is my criminal background check in Austraila (got it quick yesterday) and in Canada which I have applied for. Wondering if anyone knows how much longer or if the squeaky wheel adage applies here? i.e. contact them and ask. Good luck to everyone
