Migration (English Language Tests and Evidence Exemptions for Subclass 500 (Student) Visas) Instrument 2025

The Migration (English Language Tests and Evidence Exemptions for Subclass 500 (Student) Visas) Instrument 2025 (LIN 25/090) is a legislative instrument made under subclause 500.213(3) of Schedule 2 to the Migration Regulations 1994. It repeals and replaces the previous instrument (LIN 24/022) and commences on 7 August 2025.

The purpose of the instrument is to specify:

  • Approved English language tests for Subclass 500 (Student) visa applicants.

  • Required minimum test scores for various testing scenarios.

  • The period within which test scores must be obtained.

  • Classes of applicants exempt from English language testing requirements.

Key features include:

  • A list of nine approved English language tests (e.g., IELTS Academic, PTE Academic, TOEFL iBT, CELPIP General).

  • Lower score thresholds for students enrolled in recognised pathway programs, such as ELICOS or foundation programs.

  • Evidence requirements for English proficiency, including transitional provisions for applicants who undertook testing prior to the instrument’s commencement.

  • Exemptions from testing for applicants with citizenship or education backgrounds in English-speaking countries or relevant qualifications.

The instrument reflects updated policy arising from the Department of Home Affairs' 2022 Request for Expressions of Interest (REOI) and new Deeds of Agreement with test providers. It also incorporates external consultation with stakeholders including EVCC, AHPRA, LCA, and MIA.

This instrument is exempt from disallowance under the Legislation Act 2003 and does not require a human rights compatibility statement. It applies to all Subclass 500 visa applications made on or after 7 August 2025, unless the applicant is exempt under the specified provisions.
