Cap and Cease High Court challenge

UPDATE: Unfortunately the Cap and Cease matter has been dropped as there was not enough interest.

Latest news:  Today's radio interview on ABC

Following the pre-emptive Cap and Cease strike by the Assistant Minister and the complete lack of consultation, proceedings have been commenced in the High Court challenging the legal basis of the cease and cap.

All candidates for any visa ceased or capped (ie sc176 and 475) are being invited to join the action.

Other proceedings concerning all criminal deportation and non revocation of cancellation will also commence shortly. Professional costs inclusive of the High Court filing fees are set at $5k. Persons ceased should not ask for a refund from DIBP if they intend to fight the matter.

    there was not enough interest in the case, as far as im aware only a handful of people came up with the money required to lodge the action in the court.

    the case is not going ahead, its a shame because everyone was like "yeah lets lodge this case" and at the end of the day, no one wanted to invest in the court action and so nothing went ahead, a lot of work for nothing really

    Dear Colleagues,
    The foreshadowed class action is not going to proceed.
    I have notified the 15 brave souls who were prepared to put their money where their mouth was. Regrettably of the hundreds of enquiries and the hundreds of letters of offer that went out only 15 were really committed to this action.
    That being the case I had no other option but to abandon plans for an action in the High Court
