Cap and Cease High Court challenge

UPDATE: Unfortunately the Cap and Cease matter has been dropped as there was not enough interest.

Latest news:  Today's radio interview on ABC

Following the pre-emptive Cap and Cease strike by the Assistant Minister and the complete lack of consultation, proceedings have been commenced in the High Court challenging the legal basis of the cease and cap.

All candidates for any visa ceased or capped (ie sc176 and 475) are being invited to join the action.

Other proceedings concerning all criminal deportation and non revocation of cancellation will also commence shortly. Professional costs inclusive of the High Court filing fees are set at $5k. Persons ceased should not ask for a refund from DIBP if they intend to fight the matter.

    Well done and many thanks for the brave step taken on helpless people who have been victimized by the government's arbitrary action.

    I have about 6 pending applications which belong to these categories. Non of these clients have not received any notification that their applications are axed under capped and ceased arrangement. Has the DIBP completed sending out the notification letters by now.?

    You are a good Samaritan. I lodged my application 6 years ago and being informed that the Visa category is ceased was very hard to digest. I felt disappointed after living so many years hoping that my family and I will one day settle in Australia. You are our voice. I'm employed in Dubai at present.Let me know how can I support.

    We received one letter dated 24 September but via email on 7 October. So the date the notification received should be 7 October.

    Thanks for fighting against this injustice . I have never expected in my dreams that a country like Australia first , keep us waited for 7 years and then simply treat us a business oblect, Second why only VAC, we have spends thousands in IELTS, RMA and skill assessment fee. I want to fight against injustice regardless of the outcome. During the whole school time we learn to fight against injustice never expected this from country like Australia. Beneath every file number there is a human with emotions.
