Migration Amendment (Enhanced Integrity) Regulations 2018

The Migration Act 1958 (the Migration Act) is an Act relating to the entry into, and presence in, Australia of aliens, and the departure or deportation from Australia of aliens and certain other persons.

The Migration Amendment (Enhanced Integrity) Regulations 2018 (the Regulations) will amend the Migrations Regulations 1994 (the Migration Regulations) to support the integrity of the temporary and permanent employer sponsored skilled visa programs, set to start from 13 December 2018.

In particular, the Regulations amend the Migration Regulations to:

 specify the information that must be published by the Minister in relation to sponsor sanctions;

 clarify merits review rights for offshore applicants for certain visas;

 specify the visas in relation to which the Department of Home Affairs (the Department) may request the tax file number of an applicant for, or holder or former holder of; and

 specify the purposes for which a tax file number can be used, recorded or disclosed.

    As usual we have regulations which permit the traversal of privacy, the sharing of information between agencies etc...this is the stock in trade of the Commonwealth. Look at the conduct in relation to Sponsors for spouse visas. They are refused, they have no review rights, in making of the application they consent to disclosure and dissemination...these powers traverse the expectation of Australian citizens to marry who they like...the broad brush and quite frankly sneaky scope of the Regs exclude persons who have convictions for matters which do not traverse community expectations with respect to family violence. Those refused sponsors are denied review rights and the policy and regulatory regime is oppressive but that is ok, all you have to do to slip this stuff under the radar is to use the word INTEGRITY. I suspect that word now means as much as the words Centre of Excellence, Privacy and best of all, my personal favourite, CONSULTATION. We are going to need a new dictionary sometime soon. This is all so much like the dystopian Orwellian universe of "1984".
