Unregistered offshore practice - RMA reports from India

I have received this email from a Registered Migration Agent currently located in India.  All I can say is when is the DIBP going to do away with unregistered offshore practice?

The email I received today is as follows:

'I would like to share with you a story which is happening in India.  There is no need to be a MARA Agent to use MARA logo. Any one can use it on his / her site and can claim himself / herself to be MARA Agent.

You might be getting a feeling after reading above line that my new year party hangover is still not over. I am not drunk and I have proof with me and I would like to submit you so that you could follow up with MARA.

Today, I am somewhere in very remote area in North India and net speed is too slow. In this mail, I am forwarding you 1 link, open it in your browser and check yourself, how the [unregistered] agents are making fool of clients?

On this page, MARA logo is there but MARN No. is not written within it. You go to About Us page on www.y-axis.com, , you will not find Migration Agent name. Contract which they are signing with the clients, nowhere MARA Agent name and his MARA No. appears in  the contract.

In the above given link, Melbourne office address is there  but when u search online, you get  this address but it comes www.servecorp.com.au.

I was told by 1 client ( not 100 % sure) that if someone calls on the Australia no., call is picked in India (it gets forwarded to India and client is not aware of it). How does it happen, I have no idea? I spoke to my IT guy, he told me, it is 100 % possible.  

To my surprise, IAA, New Zealand is doing 100 times better job.

In last 6 months, they refused hundreds of application lodged by Unlicensed  Immigration Advisor. All these applications were lodged by 3 biggest players in India.

With this action, they have wiped out all Unlicensed  Immigration Consultants in India and they have created  full awareness related to “ Licensed Adviser NZ Immigration”. Now, first question client  interested in NZ Immigration is asking, are you licensed immigration advisor?   I am holding this licenses form last 4 years and no one asked in past, now everyone is asking. In every forum, people are discussing this scam and advantages of dealing with  “ Licensed Adviser NZ Immigration”.

MOST IMPORTANT:   While doing anything based on this information, you would make sure that my name is not coming (It would put my  life is not in danger here in India during my stay. I am reaching Adelaide hopefully on 6th Feb. 2014). All these 3 organisation are very big players with big muscle power.'

    I completely agree..I am from india n know very well that there are big numbers of such unregistered agents. And believe me or not they fool clients very easily , on top of that some of them even charge heavily.. ... Its a great initiative taken by MA to bring this issue on..I can make a suggestion if we can request DIBP to provide more information on australian high commission new delhi weblink and vfs services to use registered agent service it would be great.

    Y-Axis - the RMA in India seems to think that your company name is being used in India and visas being lodged from there without your knowledge. Might this be true or do you have complete supervision and knowledge of all those visa applications being lodged out of India under your company name? I note you say you have an office in Melbourne. I ask as my company name was once being used in another country with me as the migration agent without me having any idea.

    I think what the writer has said is that Y-Axis has no Registered Agents in India.
    I checked the Y-Axis website and they have put up a false list called the Occupations in Demand on their website, which is a list no longer in existence in re DIBP either.
    This I would say is highly false & misleading.

    Everytime I looked at immigration sites and immigration advisor sites between NZ and AU, i felt RMA in AU are not presented to clients in an easy way that can be achieved reasonably. Australia owns more IT professionals than NZ, surely OZ can do better job, can't OZ?

    This is an official response from Y-Axis.

    I note the Y-Axis Australia response.

    a cautionary note to all RMAs.

    When you are engaged by a third party agency you assume personal responsibility for that third party complying with all aspects of the Code of Conduct.
    Any deficiencies in a fee agreement, funds management , file management, representations etc can all come to roost at your personal professional doorstep.

    This is what Y-Axis Australia had to say:

    The failure, on the website, to provide the details of the RMAs is of itself a breach of the Code of Conduct, however given that Y-Axis Australia is not and cannot be an RMA ( it is a corporation) I guess the OMARA is going to do nothing about it.

    Further consider this..when the company Y-Axis Australia receives an enquiry is that enquiry and the consequential provision of Immigration assistance being addressed by an RMA?

    Is that advice given offshore or onshore?

    What steps are taken to ensure that the advice is accurate? Does the person who is providing the advice have professional indemnity insurance?

    What steps are being taken to protect consumers?

    What is DIBP and OMARA going to do about it?

    It is very bad and puts potential immigrant at risk I agree it is the duty of authority to have ways of promoting registered members to safeguard aspirants. Also, an strict action is required or disciplinary policy should be there to show fear for wrongdoing.

    this is actually a very popular practice for these fraud migration agencies. Let Delhi alone has hundreds of these so called immigration experts who claim to be registered with High Commissions, Embassies or Consulates and openly show authorized logos and registration numbers of MARA, MIA or MA on the websites and around their offices. Some of these agents even claim to be appointed by DIAC as offshore agents. Given below are few links:

    The modus operandi of Y Axis is simple. They have 22 offices and a hundred staff. They have 3 RMAS based out of Melbourne. If you believe that all their hundreds of applications have been personally done by these 3 agents, then I want a swig of whatever you are drinking. The clients who call up are offered a rate of 1500 AUD paid upfront. If they ask for a RMA then they are quoted for 3400 AUD. only 1 out of a thousand ask them specifically for the client agreement to be signed by the RMA and the 956 form signed and ask for a copy.

    Simple maths: 22 offices avg annual cost to run is 22 x 3000 x 12 = 792,000 AUD. Cost of 100 staff is 1000 x 100 x 12 = 1,200,000 AUD. They put in full paper ads in leading newspapers costing 30000 AUD a month. That is 1,200,000 aud a year. Total expenses is 3.192 million approximately. Adding 20% margin its 3.83 million AUD a year.
    At 1500 a case they need 2550 cases a year.
    Please tell me honestly if this is through their 3 RMAs?:D
    That's a case load of 851 cases per agent or 70 cases a month or 3 cases a day :D:D:D
    All you need to do is check the case loads/client files of the following MARA agents. 0964861, 1169662 and 1680379.

    I rest my case.

    Liana-Allan, there is no "sseem to think"" here. I have clients who went to Y Axis, got both RMA and Non RMA quotes and signed with me. I dont say that Y Axis India is good or bad. They have been advertising their success stories. 1 million counselled and thousands of success stories. I have a mailing list advert that is sent to their mailing list. If you want I will mail you. Its an Indian number.

    This proves the one we commented on and the one threatening us are 2 separate entities.
