DIBP are refusing 457 SBS, nominations and 457s for any reason 

The Department of Immigration and Border Protection (DIBP) are doing their utmost best to refuse any component of the 457 application process, but most of all, 457 nominations.

Example of a large supermarket refusal

A large supermarket with more than 20 staff in a regional area is trying to sponsor a marketing specialist.  The DIBP have refused the application on the basis that the salary offered is too low, at $55,000.  However the market salary rates show $50K-$60K and TSMIT is $53,000.  And yet the DIBP are still saying that $55,000 is too low and have refused the application without giving a chance for the sponsor to increase the salary.  The sponsor is more than happy to increase the salary to whatever the DIBP want it to be as they need the person badly.  See the end of this article for the interesting salary offered to ACS ICT case assessors in Sydney city.  Proceed to roll your eyes.

Background

PIC 4020 was introduced in 2011 to strengthen the integrity of Australia’s immigration program by detecting and preventing visa fraud.  PIC 4020 provides a ground to refuse to grant a visa where the applicant fails to satisfy the Minister of their identity, or where there is evidence that the visa applicant has given, or caused to be given, a bogus document or information that is false or misleading in relation to:

The author of the 2013 best seller Crazy Rich Asians has launched China Rich Girlfriend.  His response to criticism that he is replacing one bad stereotype (of poor Asians) with another bad stereotype (of rich Asians) was that he was ‘opening up the range of stereotypes’.

One of the biggest challenges in digesting the information overload on ‘new China’ is that the extremes are interesting but not the norm.  We suggest the normal distribution curve be kept in mind to reclassify where the information sits in the larger picture.

The following information has been received by Migration Alliance:

The Migration Review Tribunal and Refugee Review Tribunal will become part of the Administrative Appeals Tribunal (AAT) on 1 July 2015.  We will be known as the Migration and Refugee Division of the AAT.

The fee payable when lodging an application with the Migration and Refugee Division of the AAT, for review of all visa refusals and cancellations, except protection visas, will increase to $1,673.

Recently we have experienced a high volume of complaints from migration agents about "Customer Service Manager" being refused under sc457 nominations.  The refusals are always due to 'non-genuine' criteria.

Reports in from RMAs state that case officers are 'assuming' things and making decisions on their own assumptions.

RMAs want better goalposts around what is and what is not considered 'genuine'.  Different case officers have different opinions and there is no uniform decision making.
