Fee increase: MRT-RRT

The following information has been received by Migration Alliance:

The Migration Review Tribunal and Refugee Review Tribunal will become part of the Administrative Appeals Tribunal (AAT) on 1 July 2015.  We will be known as the Migration and Refugee Division of the AAT.

The fee payable when lodging an application with the Migration and Refugee Division of the AAT, for review of all visa refusals and cancellations, except protection visas, will increase to $1,673. 

The fee payable after an unfavourable review decision is made by the Migration and Refugee Division in relation to a protection visa will also be $1,673.

In cases where a 50% fee reduction is granted the reduced fee will be $836.50.

Application fees are required by law to be adjusted every two years in line with the Consumer Price Index.

The new fee will be reflected in updated application forms, available on our website from 1 July 2015.

    As the MRT/RRT is joining with the AAT, does that mean RMAs (non-lawyers) will no longer be able to represent at the MRT?

    That's a good question.

    If the answer is "yes" (that RMA's will no longer be permitted to represent at a review hearing) - the result is another question: is this the purpose of the merger (of the review tribunal)?

    It "ties in" with:

      the recent push to allow lawyers not to be registered with O'Mara - but still provide migration advice. The "convenient" situation where "skill select system" effectively take RMA's 'out of the picture".


    How long before the client (applicant) has no real chance to advice - other than the department website - which I would describe as inaccurate in some way, somewhere, every day.

    The AAT has always been open to RMA's and other organisation representatives like those representing Veterans appealing unfavourable VRB decisions

    AAT is also equipped to allow non-lawyers appear for applicants.
