Changes to Sanctions for Zimbabwe: Amendment (No. 1) Instrument 2023

Important news regarding sanctions for Zimbabwe! The Australian Government is making changes through the Autonomous Sanctions (Designated Persons and Entities and Declared Persons—Zimbabwe) Amendment (No. 1) Instrument 2023.

Background: Autonomous sanctions are non-military measures imposed by a government in response to global concerns. In this case, it's about situations in Zimbabwe affecting democracy, human rights, and the rule of law.

What's Changing: The Australian Government has regulations, and this change focuses on proscribing people or entities for financial sanctions or travel bans related to Zimbabwe. The Minister for Foreign Affairs can designate or declare someone if they've seriously undermined democracy, human rights, or the rule of law in Zimbabwe.

Why Designations and Declarations: Designations put financial sanctions on someone, restricting asset availability. Declarations prevent a person from traveling to, entering, or staying in Australia.

Recent Changes (2023 Instrument): The latest instrument makes two key moves:

  1. Renewal: The designations and declarations for five individuals are renewed because they've engaged in activities undermining democracy, human rights, and the rule of law in Zimbabwe.

  2. Lapse: One entity, Zimbabwe Defence Industries (PVT) Ltd, won't be listed after its third anniversary (13 January 2021) because it doesn't meet the criteria anymore.

Key Dates:

  • Sections 1 to 4 and Part 1 of Schedule 1 commence on January 12, 2024.
  • Part 2 of Schedule 1 commences on January 14, 2024.

What You Need to Know: This change doesn't affect existing visa holders, but it's essential for employers to ensure their workers have the right visa.
