I have commissioned an advice from Senior Counsel and have now been tasked with finding the perfect Group 5 candidate for foreshadowed legal action.
I am requesting that the word go out for a candidate who is as close to perfect as against the following:
1. The candidate applied more than 5 years ago.
2. At the time of the application the applicant met all of the criteria for the grant of a visa.
3. The applicant is married and has a secondary applicant husband or wife.
4. The candidate has a child born in Australia who is now under 10 years of age.

Dear Chris I am waiting for more than 51/2 years. I applied 176fs in Dec 2009.Did 2 years in Hospitality got all certs and documents submitted accordingly as required by the department.TRA done and work experience completed and submitted in 2009.I applied online but till this day no updates and response from immi department. Please sir if there is any update please let us know. Your help is greatly appreciated by all of us group 5ers.Thanks.
The pre emptive strike by DIBP via cease and cap blew my case out of the water but I have found an alternate pathway which will blow the cease and cap out of the water as well as the legislative instrument. The only catch will be that the poor candidates will have to stump up $5k to make an individual application to the High Court ( that includes the High Court filing fee). This approach is necessary because I anticipate that Parliament will react to fix the problem and lock out those candidates who do not file an application. I applied for a 176 visa on 16th October 2008, 43 years old at the time my visa was lodged. My husband was a serving police officer and my only child was 17 years old. Now aged 50 my husband now retired from the force and my daughter now 24 years old. We have no chance of gaining another visa for permanent residency due to myself and my husband being in our 50's and my daughter would have to apply independently for her visa. I am now too old for another visa category and too young to apply for a retirement visa.
