Changes to ENS/RSMS from 1 July 2014

Changes to ENS/RSMS from 1 July 2014
On 1 July 2014 the Regulation 5.19 PAM3 which provides policy advice concerning the Employer Nomination Scheme (ENS) (subclass 186) and Regional Sponsored Migration Scheme (RSMS)(subclass 187) nomination legislation will be updated. A major change to the provided policy advice will be the alterations made to the requirements under the Temporary Residence Transition stream when demonstrating two years’ work with the same employer. The department has determined that the previous policy which utilised section 50AAA of the Corporations Act 2001 was too restrictive, particularly where businesses have undergone change in the form of restructures, takeovers and sales.
As a result, the department has determined that on 1 July 2014 policy advice will be updated and will instead read as is attached to this email. Please note that the Regulation 5.19 PAM3 excerpts attached will not be published on LEGEND until 1 July 2014 and will therefore only come into effect from 1 July 2014. The updated policy advice will apply to all applications on hand at 1 July 2014, as well as all applications lodged from this date onwards.

Hi I had same company name but new employer and new ABN so what's change and can I apply ens on December 2014 I had old employer nomination and visa 2012 this December finish 2 years otherwise start next 2 years from new nomination in 1 July 2014

My name is Ruby and I work for 9 months with employer in 457 and then I change the employer.I work with new 4 months if I go with old employer with whomever I work before then my 9 months will be counted. -

Already I did new ABN but I means can I use new and old both year cover after July apply ENS or start from my two year after new ABN but my group certificate give new ABN so had new ABN pay slip

hi my name is balli..i have applied rsms 187 direct stream on 28th of march 2014..nomination approved on 15th may 2014...case officer asked for my wife's english test and my sons pasport and medical...evrything provided to the CO..is the 1 july changes can effect my visa applicatio..or it will be decided on the basis of earlier ragulations.??..plz state sombody..ur help will be life saving..!!

What's change rules let me because I had change employer before 4 months now new owner bought shop he did nomination again for me same place and different employer when I can apply ens because finish my 2 years in November -

Hello this is bali Singh I just wanna know that I hold 457 visa now and I got that 4 feb 2013 still working with same but my employer got banned regard for 457 visa and they said you can't apply ur ens from here so anyone can tell me that my work time will be get counted or not and also I got my tra in 2009 and I don't have ielts 6 band. So any suggestion what is the best way for me.thx
