Breaking Australian immigration news brought to you by Migration Alliance and associated bloggers.
Jennifer Fong, Registered Migration Agent, just notified me that she has been to post a query through the DIAC's Agents Gateway and after completing her details and inserting her MARN onto the screen she has been provided with a popup message which is linked below and attached in the pic. The message forces her to agree before posting her question to the Agents Gateway.
I am wondering if Migration Alliance should create one of these kinds of messages too where DIAC case officers must go through a 'I agree' before contacting an RMA. Terms such as:
1/ I agree that I have read the legislation and know how to interpret it before asking the RMA to do something
2/ I agree that I understand the Migration Act and am not going to ask the RMA to do something outside of the legislative criteria or jump to conclusions regarding the merits of a case prior to seeing the evidence before me (ie 'discretion')
3/ I agree that I will provide my full name and my position number and that if an agent believes I am not competent that I will be referred to This email address is being protected from spambots. If anyone would like us to design such a concept for use on emails where engagement with DIAC case officers is necessary let me know and we will get building.
Let's not forget, it is migration agents who are trained and properly educated in Migration Law, and have evidence of such. DIAC case officers have no such evidence.
What happened to working together? What happened to 'people our business'?
Dear Liana,
What is DIAC's problem. This pop up is clearly calculated to intimidate bonafide questions from RMA's. I am sickened and revolted by their arrogance and frank contempt. Let me make this offer to any RMA..if you want to know something ask the real experts at the MA forum.if they don't know ask me...I certainly won't be dibber dobbing any colleague to OMARA. I am certain that any of us have more experience and expertise than these bullies!

Often there is such a fine difference between a policy question and a pre-lodgment query, actually when I think about it aren't most policy questions done at the pre-lodgment stage, anyway where do DIAC draw the line in the sand? Who has the final say about which it is - they do of course. So I get dobbed into MARA for asking a policy question that they deem to be a pre-lodgement query... why do we even bother?
The Director of the Migration Agents Section (MAS) in Canberra has written back to me and asked me to send her a copy of the message displaying on the Agents Gateway. MAS is aware that we consider it inappropriate. I have asked her to reconsider the message in the spirit of 'working together'. I have sent the screen shot through so we will have to wait and see.
