On 19 June 2019, the Federal Court of Australia ruled that the Australian Government has to consider applications for refugees on Manus and Nauru made under the Medevac laws that are made in line with standard Australian medical practices.

In its findings, the Court noted expert opinion that medical professionals can evaluate a patient’s need for further assessment or treatment, without any personal engagement with the patient, on the basis of notes of other practitioners or information gathered from third parties.

Shortly after the Medevac laws passed, the Nauruan government passed legislation to ban doctors speaking with patients on Nauru for the purpose of medical assessment. David Burke, a Senior Lawyer with the Human Rights Law Centre said:

Immigration SA has announced that they have met the Federal quota of Subclass 188 and 132 business nomination approvals for the 2018/19 financial year. 

Subclass 188 and 132 business nomination applications that have already been submitted but not processed, will be processed from July 1 2019, when the Federal quota for South Australia resets. The online application system will remain open, and will continue to accept business nomination applications.

In a Migration Law Updates email yesterday titled " Good news: AAT reopens "late" application" by Sergio Stagliorio, Sergio (aka the writer) writes about Mark Northam and himself recently summarising the Federal Court (Full Court) decision in DFQ17 where it was held that a "late" Tribunal application was actually NOT late.

To be clear about this, and to give credit where credit is due, Michael Arch, member of the Migration Alliance committee first wrote a full and concise summary about this topic on 29 April 2019 in his article titled "Important Case about Late Filings in the AAT.  Salvation may be at Hand".
