Australian Border Force execute search warrant on migration agent's home and property

Migration Alliance has been given permission to publish limited information in relation to a recent search warrant executed on the residential home of a migration agent on Thursday 12 November 2015.

The Registered Migration Agent (RMA) was making herself a coffee in the morning. She then heard shouting,

'Police'.

Australian Federal Police (AFP), Australian Border Force (ABF) and other 'security' were on the doorstep and pounded on the front door. After the agent answered the door a male stood over her, approximately thirty centimetres away from the migration agent's face. A male enforcer of middle-eastern appearance was shouting at her:

"We are here. Sit down. Is there someone else in the house?"

The agent reports to Migration Alliance that she had to ask him to back off as he was intimidating her.

Under the Crimes Act, the following things have been searched from the premises of the RMA:

  • Car 
  • Laptops
  • Computer hard drives or other electronic storage devices
  • Mobile handsets
  • Mobile telephone subscriber identity module (SIM cards)
  • Media storage devices
  • Computer printers and sample prints

In addition to the above, the search warrant included:

  • Immigration-related client and customer lists
  • Immigration-related client and customer records
  • Contracts of Employment
  • Contracts or agreements
  • Correspondence
  • Correspondence relating to work experience and work references
  • No less than 51 records for different Pty Ltd businesses represented by the RMA, in alphabetical order
  • Files relating to DIBP / DIAC

Some of the items have been retained by the ABF and not yet returned to the agent.

The RMA reports that about twenty (20) ABF turned up, complete with guns and raided her home.

The agent, agent's husband and 3 children live in a quiet neighborhood. It was very lucky that the children were not there at the time as they had just left for school.

The RMA has not been charged with any offences yet.

The ABF/AFP still have the RMAs mobile phone.

The ABF/AFP took cash from the pocket of a jacket inside the cupboard in the bedroom.

A female officer from ABF handed over seizure notices.

They even took the son's computer which has nothing on it but games.

The RMA does not believe that she or her husband have committed any crimes and genuinely has no idea why the ABF/AFP turned up to her home.

The RMA also believes that the ABF/AFP will find nothing.

The agent believes that the complainant is a case officer within the DIBP. The RMA made the ABF/AFP aware of this. The agent has lodged numerous complaints against this particular officer. The case officer has also received complaints from this agent's clients.

The agent said to the ABF/AFP:

"Are all these people necessary? Is this what my taxes are going to? I was born in this country and I am sixth generation Australian and I would never let anything happen to this country."

    nothing at all surprises me about DIBP any more .........I have over the years experienced some horrendous incompetent people within the Department . BEWARE if they want to get you they will . Cross too many people in the department you will face the wrath of the department and OMARA

    The OMARA did not want to request documents from the registered immigration agent, therefore they used force in the way of a search warrant and seizures to obtain all the agents, clients files, usb's, computers and all paper documentation. It certainly was "over-kill" and totally unwarranted. The OMARA & DIBP are held answerable?? as to why this took place and why with such force? This is going to take along time to figure out, but I believe its victimization on behalf of a case officer at DIBP who the agent had alot of bad dealings with. It certainly makes you want to give up being an agent for good. Something like this knocks you about!

    It seems to me that the allegation is far more serious then misconduct of a registered migration agent which usually managed by OMARA.

    Unfortunately now AFP and Border farce are programmed/trained to believe there are terrorists lurking under every bed. They think they're doing their duty to their country. Very scary stuff indeed.

    The agent in question was born in this country and is sixth generation Australian, she is highly unlikely would have any link or associate with terrorist. Hopefully she did not give away, or has lost her sim card.

    Wei-Firstly I need to caveat my response by saying I don't know the facts and I can say that the majority of people on this forum also do not know the facts so all comments are purely speculation and conjecture Therefore this is by no means a definite statement so cannot be used in any defamation procedure as the following statements are hypothetical scenarios only since the agent in question has not been identified.
    Assuming terrorism is involved, the agent may be innocent herself but she may have clients who are not innocent even without her knowledge because clients have been known to withhold information, so this may be the reason the AFP may have targeted her so aggressively. She herself is not in jail but they just confiscated her files. If she has not been arrested, it may be open to assume she has no personal involvement.

    Assuming the worst and she is somehow involved personally a person can be a 6th generation Australian but still harbour sympathies with the terrorists. I would suggest an excellent book- United in Hate: The Left's romance with Tyranny by Dr Jamie Glazov.

    If I was this agent I would consider the Commonwealth Ombudsman as my first point of call.
