The DIBP's secret 457 training benchmarks survey

I have sent the following email in to the DIBP's head of policy and Manager for 457 visas in Sydney:

Hi KKKK and BBBBB
Please find attached a survey which has been sent to organisations in the 457 training benchmark space.
Could you please let me know if this survey is rooted in legislation (ie does the DIBP have the power to compel organisations to provide information), or is it a voluntary survey only?
I am sorry I don't seem to be able to find the relevant legislation which would give the DIBP the power to request the information in this survey.
I have had a look at the Instrument and there's nothing in that.

    I agree with you Liana.

    This is a DIBP intelligence and information gathering survey and DIBP have no power to request the information they are requesting from these organisations. If the DIBP want to make sure these organisations fall in line then perhaps they should have created a formal approvals process first. Application form. Approved. Monitored according to the obligations in the application form much like a sponsor. Otherwise all of this is just knee-jerk reactions from a Department that did not think (or ignored advice) it through.

    Had a quick look at the Act and Instrument and I can't see anything in there that gives the Department the power to try and extract this information from organisations which are not under it's control and who have no formal relationship or agreement with the Department. It is simply a case of the Department going outside of its powers in my view. They certainly want a lot of information. I guess if they don't play ball then the Department can pull the rug?

    It's yet another cynical method Immigration uses to put migration agents out of business because the culture in the department is one when it comes to migration agents is "guilty until proven innocent" or a felon without trial. This is a phishing expedition because they are operating from a default position of any avenue of revenue derived by migration agents must be derived by fraud or criminal conduct so they are scrutinising associated businesses like those providing 457 training benchmarks. This is one reason why they have now outlawed commissions given by training organisations to migration agents and rendered their programs useless. By the way, I don't derive an income stream from organisations providing commissions for the 457 benchmarks so I don't have a "financial interest" in posting these remarks.
