India’s highest court has ruled that homosexual sex is illegal, and punishable by life in prison.
Does this mean we are set to see a flock of refugee applications to Australia?
Section 377 - ‘‘Unnatural offences’’ - states that ‘‘carnal intercourse against the order of nature with any man, woman, or animal’’ shall be punishable by life imprisonment.

This legislation will reflect upon many people and many nations; none more so than India which will be seen by so many as being both oppressive and regressive . This is surely grounds for a reasonable fear of persecution as per UNHCR definition of refugee and may actually encourage homosexuality to provide said grounds. Was this the intention? Whilst I am not homosexual, many of my clients are and I have respected them for the decisions they have made in spite of social pressures to do otherwise. To have a Government of any nation deem that to love another human being is punishable by life imprisonment is an affront to humanity.
