Update: New Instrument Governing Courses and Exams for Registration as a Migration Agent (Commencing 1 April 2026)

The Migration (Specified Courses and Exams for Registration as a Migration Agent) Instrument 2026 (LIN 26/002) has been introduced and will commence on 1 April 2026, replacing the previous Migration (IMMI 18/003: Specified courses and exams for registration as a migration agent) Instrument 2018.

This legislative instrument specifies the approved courses, prescribed examinations, minimum examination scores and completion timeframes required for individuals seeking registration as a Registered Migration Agent (RMA) under the Migration Agents Regulations 2026.

Key elements of the instrument include:

• An updated list of specified migration law courses accepted for registration
• Confirmation of the Migration Agents Capstone Assessment as the prescribed examination for eligible applicants
• Expansion of accepted English language test providers
• Clarification of minimum required scores for English proficiency tests
• Extension of the validity period for English language test results to three years
• Transitional arrangements for certain courses and examination scores

These changes form part of the modernisation of the migration agents regulatory framework and aim to ensure that education and assessment requirements remain clear, current and aligned with professional competency expectations. The instrument supports the objective of maintaining a competent and qualified migration advice profession and protecting consumers from unqualified migration assistance.
