The Capstone complaint letter sent to the Minister and others

The following email has been copied to Migration Alliance today, and has been sent to various Ministers and Senators in Australia.  Migration Alliance has not been part of the construction of this letter, nor in assisting the participants in the Capstone in any way.  Permission has been granted by the author to publish.

Dear Sir/Madam, 

We as recent Migration law graduates who have completed Graduate Diploma in Migration Law and Practices (GDMLP) and preparing to register with your office, together with continuing students who are in the process of completing this Diploma, jointly write to you in this letter regarding the above mentioned assessment. 

We strongly believe that Capstone assessment is unnecessary and unfair. Introduction of this assessment raises serious questions over the abilities of Australian Institutions involved in the delivery of Graduate Diploma in Migration Law and Practices (GDMLP), that includes the Ministry of Education itself. 

The introduction of Capstone test raises serious questions over the abilities of Australian Universities to teach and test their students .

 

Capstone assessment was introduced last year (2018) for Migration Law Graduates or candidates who seek to register with OMARA to become Registered Migration Agents (RMA). We understand that this assessment has been introduced to maintain high standards of professional knowledge among Migration Agents and to maintain the quality of service they provide to their clients. We also understand the fact that in the past many or some Migration agents have exploited their clients and caused issues for authorities in the past because of their unethical practices and lack of professional knowledge. We believe these types of Migration Agents are still there involved in unethical and unprofessional practices. 

Many students who graduated last year with Distinction/High Distinction from different universities took this exam in February this year and have failed Capstone assessment due to, what we believe, is unrealistic testing and its environment. 

We all candidates mentioned at the bottom of this letter, request you to address the issues raised below to make Capstone assessment fair for everyone. 

  1. 1.    Time frame: The exam is divided into written and oral exam. The oral exam is held for 1.5 hours while the written part is held for three and half hours and is divided into Part A - Multiple choice questions, Part B - Short answer questions and Part C - Practical writing task, Client letter and submission letter. The time frame for part A is 36 minutes, Part B is 60 minutes and Part C is about 2 hours. The reason of failure for most of the candidates is the unrealistic and unfair time frame of part C. Most of the candidates found that the time frame is not enough for completing a letter to the client and submission to the Department of Home Affairs in about 90 minutes which is the approximate time left after completing other parts of exam and reading the case scenario. Most of the candidates found that addressing the complexity of the case scenario and writing letters need at least another half an hour.

The candidates who started with part-C could not complete one or the other parts of the assessment. 

  1. Compulsory parts and passing marks: The passing mark in the exam is 65% which is much higher than the other exams conducted in various other fields. We think it is unfair but still that is not an issue for most of the graduates to get 65% overall who have passed with good marks from Universities. The main issue is getting 65% in Part- C is compulsory to pass the assessment, which seems impossible due to the time frame given to complete part-C. Our request is to either increase the time frame to complete Part- C or decrease the passing percentage to 50% in part C. 

      To comment on ‘Oral assessment’ of the capstone exam, it seems that the college of law has failed to comprehend the depths of the migration law. The duration of the oral exam was for 1.5 hours where students were provided with on the spot scenario and were asked to prepare for it in 15 minutes. The real challenge was to assist the client for 50 minutes with complicated queries. The college of law assessors played the role of very difficult clients who demanded the students to provide the maximum visa options  of at least 6 - 7. Students were put under immense pressure throughout the oral exam because the assessors were pushing the students to rush in. The worst part was where students were only allowed 15 minutes to write a file note, which is impossible in the real-life scenario, given that students are inexperienced and the speed that ‘The School of Law‘ wants to see, comes with the combination of experience plus time. 

  1. Capstone assessment is not a requirement for existing agents: The new Capstone assessment was not imposed on existing Migration agents which is totally unfair on the new candidates. The existing agents have only completed Graduate Certificate which used to be 6 months while the new candidates have completed Graduate Diploma which is of 1-year duration. The old agents only paid about $12000 while existing candidates have paid $25000  to get the qualification. Most of the candidates have left full time work to complete this intensive study and have struggled to pay Capstone exam fee of $2750 and now they are being made to sit in the exam again for $2200. 

It would be absolutely  fair if all existing Migration agents are required to pass this assessment to continue their registration with OMARA, including the one who assisted OMARA in preparing the structure of Capstone  assessment. 

  1. Money making Drive: We believe that Capstone assessment is a money making drive. New aspirants who want to become registered migration agents are financially burdened as the application fee to sit in the test is unrealistic. To sum up, we would like the College of Law to justify the amount of fees ($2750) students have paid to enroll in this Capstone assessment. It appears to us that “this assessment is a money-making strategy for the college of Law or whoever is involved in deciding the assessment fee structure, as the application fee is exorbitantly high”. We really question the structural fairness of this capstone assessment in terms of fee, amount of support provided to the students by the college of law, exam content and the duration of the exam. 

For students Capstone testing fee of $2,750 is unrealistically high and by considering the number of fails The College of Law is making it won’t be one off. Even $2200 to re-sit in the exam is not justified at all. 

       As we all are aware that in the first year of registration, RMA’s must meet the criteria of required CPD points that allow the newly registered migration agents to enhance their legislative knowledge and hone their skills. There is no denying that the migration law is a dense subject and require experience to provide expert and in-depth advice on complex issues. On the contrary, it’s unfair to assess fresh graduates against such rigorous criteria. Rather, volunteer work experience could be a choice or compulsory hour of training can be introduced or attending Tribunal session could be made compulsory which may make a positive impact to student’s knowledge and practical developments. 

        Students could  go and attend the Tribunal in their own time and could have applied for volunteer positions within AMIS Australia. 

        Furthermore, we strongly believe that the purpose of the Capstone assessment in the present structural format is to stop entering new Migration professionals into the business than maintaining or raising professional standards. The clear evidence we see here for that is, not including existing Migration agents in this so called rigorous Capstone assessment. 

We urge the OMARA to investigate the issues raised in this letter against the college of law and check the structural flaws of Capstone assessment in order to make the assessment fair for everyone so that the new graduates could pursue their career as registered Migration Agents.

    Paul O you appear to be the only person on that side of the argument that has talked any sense and understands nuance and how to interpret legislation as per above - if the people against capstone had any brain they would put you in charge of the fight. Need logical, reasonable, rational and competent operators presenting the argument.

    The whole issue to me seems to be that the diploma does not prepare students enough for the capstone test. If the difficulty level of the capstone test needs to remain, then students should not be mislead to think that completing a diploma will enable them to become a qualified migration agent. It's wasted money and totally unfair. I myself have entered the diploma course with no background in law and was told in my first online lesson this evening that only 50% of students enrolled passed the capstone test. This alone has made me wonder whether I need to cut my losses and exit now.

    Then how can you justify the cost of $2750. Are you compensating the cost from us for the damages caused by previous agents. If you are really concerned about the quality then reduce the cost and make it $500 or less so that we can improve our competency according to the suggestion made by you. It’s not easy for student to pay $25000 plus $2750 plus more. You really need to put yourself in our shoes.

    That's why its unfair that only the new graduates are made to take the exam. All RMAs should be required to take the Capstone to renew their registration noting your comment about the many incompetent registered migration agents. If even the old RMAs are included to take Capstone maybe they would not charge such exorbitant fees.

    Pat RMA applicants had to meet the criteria for licensing at the time they qualified.
    Current applicants have to meet current criteria

    If you are suggesting that the test should be for New Agents and Licensed Agents I would be agreeable to that if the test was at advanced levels to which the knowledge of Practicing RMA's have. This would further disadvantage you and other new applicants.

    The problem you would face is if the Existing Agents all or mostly pass the Capstone then what would your complaint be.?

    Your effort to have it removed or changed would be groundless.
    Your assumption that experienced migration Agents would fail is flawed

    I do not need 15 minutes to prepare for a client interview. I do not prepare at all for client interviews. I have years of experience and know what I need to ask, look for in evidence, qualify an applicant and determine the best visa option for them.

    Suggesting new graduates are and should be at this level is a flawed attempt to justify the need for the change to or elimination of Capstone.

    I suggest you focus on the facts of the situation and do not include other areas that will cause you grief.

    The capstone test is flawed
    Focus on the flaws
    Present you case based on those flaws
    Then you have a relevant dispute to present

    Paul O, Please keep quiet and enjoy your Registration. This petition is not addressed to you. I am 100% sure that you will never pass the current Capstone Exam just by reading your demeaning comments, no matter how smart and condescending you are trying to be.

    I have given my assignment to existing RMAs and some Migration lawyers with 10+ years of experience to test their capacity, guess what? None of them was able to provide correct answers to the basic assignment question. The excuses were; ‘Oh sorry that not my area of expertise’, Oh! ‘I have never done this visa before’, and ‘what's the answers then’? Few honest ones said to me; ‘I don’t think I can pass this exam’ and I note these were only University assignments, not Capstone Exam. I have proof and happy to provide it to you in private if you want. Please be humble and refrains from undermining other peoples struggle, you haven't sat the Capstone Exam, you can't really tell us with a great deal of confidence that you can pass it simply because English is your first language. Most of New RMAs that have passed the Capstone Exam and succeed to enter the profession are former migrants with English as second language, but they have shown strong resilience and succeed in something you couldn't if put in the same situation.

    For Example, studying in Russian, French, Italian, Punjabi, Mandarin, sit a test pass, and practice in a language you have learned as an adult. You see mate; we do not all face the same challenges in life. So leave these who are struggling to make it even in unfair and uneven playing field to try. And enjoy your privilege peacefully, no one is trying to take that away from you.

    Either you are an RMA or a Lawyer, one day you can lose your registration or get licence suspended, trust me you will never pass this test. For your information, OMARA is making RMAs found in breach of Code of Conduct to sit a Capstone Exam before getting their registration back. If that happens to you, trust me you will give up practising Migration law. You don't have what it takes, so stop being an A-hole and undermine other peoples.

    Existing RMAs keeps arguing that they have a lot of experiences so they don’t need to take the test. My viewpoint is: once you take the test and pass the test, then make comment about the test. How would you comment the test as if you have passed it? The fact is not, you haven’t even know how it looks like. . What you are arguing because you are afraid OMARA will take an action in favour of the petition which require both new and existing RMAs to take the test.

    Let pass the test first before giving the lessons to others.

    Simon with all due respect we are only asking for a fair chance to prove our skills.I am sure you being an experienced RMA will agree that complex submissions cannot be drafted in 1 hour.I am sure you are aware that time is required to go through complex scenarios and requires indepth study of migration law to come to a conclusion.We failed not because we are not equipped to answer the questions but because of lack of TIME.All we are asking for is adequate time to address complex migration issues and the present structure of capstone exam does not allow us that.The second issue that we are fighting about is that this exam is expensive by any standards.I would request you to understand the real issue before jumping to the conclusion that we are not ready to take on the challenges of migration industry.

    the fact is that high % of those potential agents that cant or can barely pass the exam will be out of the industry in 1-2 years once they realise they cant make any $$ - let alone a quick and easy buck even with the no overhead model of a backyard office.

    This has always been the case if you follow the high percentage of agents that quit during that period in their so called careers. It tends to only be those that get to 5 years that continue to last in the industry - much lower % drop out after that time.

    Cut your losses and move on with your lives and take up a career more inline with your ability.

    Seriously concerned that some of the people posting comments here that are complaining about the standard could be let loose on the general public given the standard of their comments.

    Candidates will complete an online exam with two components:

    Part A) a 3.5 hr written component (consisting of multiple choice, short answer and practical writing tasks); and

    Part B) a 1.5 hr oral component (face to face through web conferencing, covering a client interview and a file note).

    Part A:

    Does Part A uses a webcam to validate the person sitting the online written exam?

    If not, what is the validation to ensure integrity of the online written exam?


    Part B:

    Part B uses a webcam. Is the interview recorded ?

    I have been following the discussion and I agree wholeheartledly with the indications that the Capstone exam may not be fit for purpose.
    I will do whatever i can to help but i will need the assistance of volunteers who can investigated why we are all in this mess.
    I think it is fair to say that if you have an unusually high failure rate for candidates that may be a prima facie indicator that the exam is either not harmonised with the entry level course or that the capstone is seeking to test something outside its intended purpose.
    As to whether an injunction can be sought to restrain the OMARA ( The Commonwealth) and the College of Law will depend upon what evidence ( apart from a high failure rate) is available.
    Could those amongst you with the time to assist please contact me by email and I will ask you to do an investigation into the various elements underpinning the current controversy.
    It seems to me that the parameters of the investigation should embrace the following:
    1. The decision to implement a capstone exam ( not the recommendation)
    2. The decision to engage the college of law as the monopoly provider
    3. The decision to not have multiple providers
    4. The decision as to the the format of the exam
    5. The role of the OMARA/DOHA in the formulation and approval of the testing regime.
    6. The curriculum
    7. The design of the exam, who designed it and for what purpose
    8. Who was the author of the exam and what were their qualifications
    8. The cost to candidates and how that price was agreed upon
    9. The qualifications of the markers of that exam.

    I will ask that MA put together a questionnaire to identify the primary concerns of the RMAs who have had this gross impost foisted on them.

    If the authorities want to improve the standard of migration agents, they should not improve it at the cost of migration students. Capstone exam costs 2750$ and passing rate is less than 17%. Students can only undertake retest after waiting for 3 more months and at an additional cost of 2200$. Furthermore, there are maximum three attempts students can take. This limitation of attempts put extra pressure on already stressed students. Students who have already paid 24,000$ for the fees are required to pay additional 27500$-7100$ and have to waste one more year before they can start their work. With passing rate if less than 20%, chances are that 40% students will never be able to pass the exam after three attempts and will never be able to work even after wasting more than 3000$ and more than 2 years of life.

    This system seems to work only for already registered migration agents who never had to go through 12 months of university education as well as difficult capstone exam. In addition to that, they don’t have any competition from the upcoming migration agebts as well. What a shame!!

    Anonymous: Do you think your comments would be applicable to the doctors, nurses, dentists etc. Who should be responsible for improving the standards of these professions?
    Based on your comments improving the standard of Nursing should not be built into the exams or Bachelors degrees and some one else would take responsibility for up-skilling the nurse after they are licensed and possibly a danger to the patients.

    If the standard is there, you need to meet it to be eligible to practice: To meet standards, testing processes are in place.
    The argument you are putting here is going against you. It is not in your favour. You cannot exempt yourself or new applicants for any profession from meeting the entry requirements, no matter what they are.

    You can challenge them. Seek to have them changed but remember the changes are as a result of an extensive report prepared for MARA and Immigration in this case.

    The implementation and basis of the test can be challenged but not the need to improve the standards.

    No one is required to pass any registration exam if they have graduated from Australian university. Medical and Dental graduates are required to sit for registration exam only when they have graduated from overseas universities. Additionally, their pass rate us much higher than this exam. Try solving a Capstone written paper in 3.5 hours and let us evaluate you. Thank you

    You should remember that the intensive report that you mentioned above has been caused by the existing RMAs, not by the new candidates. In order solve this problem, the incompetent RMAs need to be eliminated first.

    I would be asking these questions of the College of Law.

    How do the questions in the Capstone Exam relate to the level of teaching and knowledge needed by an applicant to pass the Diploma of Law?

    How would the applicants assess their knowledge given this is stated in the Manual as a recommendation to students to assess their knowledge before taking the test and if the knowledge is not up to standard to delay the Capstone Test

    AND
    What research was done into the content and assessment criteria for the Diploma of law by The College of Law?

    AND
    What expectation of knowledge is considered to be necessary to pass The Capstone test?

    This complaint letter is not also fair to those who pass the capstone test. It is a good thing for OMARA to increase registration requirements year after year. Just like the previous request for IELTS 7 points, we did not complain and accepted it silently. There are also many people who are not able to register as RMA because of poor IELTS results. Is it fair?
