Mandatory Qualtrics surveys of RMAs via DIBP via the OMARA and no s308 notice

This is another email being received by RMAs after they have received the 'random monitoring' email (please note that Qualtrics software is located in the USA with phone number 800-340-9194):
 
Dear Agent,
This morning you would have received an email from Qualtrics requesting your cooperation to complete a survey about your company’s ‘No Win No Fee’ or Conditional refund policy.
Please note that Qualtrics is the OMARA’s third party survey provider. The survey is mandatory and needs to be completed by Wednesday 25 March 2014.
If the survey from Qualtrics did not appear in your email inbox, please check your other folders including spam/junk.
If you have any queries regarding this survey, please do not hesitate to contact me.

    This email has been sent to the OMARA this afternoon:
    Dear LLLLLLL
    Could you please advise whether the surveys being sent to RMAs are in fact compulsory / mandatory?
    I cannot find any power which has been properly exercised which would require an agent to complete the survey.
    Could you also advise why the surveys are not properly locked down with a login and password specific to each agent before completing the survey?
    Finally, the software being used Qualtrics is a private third party program based in the USA that does not belong to the DIBP. Given that the data is not stored by the DIBP why would agents be comfortable sending private data to such a program? If it is not stored and owned by the government then the information is not likely secured/treated at an Australian government security level.
